Daniel Kelly

Daniel was born circa 1755. He was the son of John Kelly. He married Sally Clifton, daughter of Allen Clifton. Daniel died after 1838 at Newton, Georgia, United States.
Biography of Daniel Kelly:
The Delaware Record
Daniel Kelly and his wife, Sally Clifton, probably were married and started their family in Sussex County Delaware about 1776-1778. This date is based on their son, John, being born about 1779 or 1790. We estimate Daniel as being born about 1755. That is based on his being about 25 years of age when his first son was born.
The earliest records we have found on Daniel Kelly is his name first appearing on 17881, 17892 and 17913 lists of Taxable persons in Broad Creek Hundred, Sussex County Delaware.
We also know that he was living in Sussex County as early as 1778, the beginning of the Revolutionary War. This is based on a deposition4 he made in 1828 supporting the Revolutionary War Pension Application of George Clifton then of Clarke County, Georgia. George Clifton was born in Sussex County Delaware and did receive a pension for his service on the Delaware Line. In that deposition Daniel Kelly under oath stated “That he is personally acquainted with George Clifton and has been personally acquainted with the said George Clifton for the space of 50 years or upwards…” suggesting that he was living in Sussex County as early as 1778. Interestingly, nowhere in this deposition does he mention that he ever served in the Revolutionary War. Nor have we been able to find where he filed for a pension for his service which he would have been eligible for if he had served. Thus, we found no evidence that he served in the Revolutionary War.
His name next appears in a 1795 Sussex County land deed5 wherein “Daniel Kelly” and his wife “Salley Kelly” sold 75 acres of land to John Lord on 6 October 1795. The deed is witnessed by Benjamin Clifton who we believe is a first cousin of Daniel’s wife Sally Clifton. Based on the deed, the property is in the “Northwest Fork Hundred” on the Nanticoke River suggesting that between 1791 and 1795 he removed from Broad Creek Hundred to the Northwest Fork Hundred. Today, the same property appears largely intact as cultivated farmland. The Lifeway Church of God at 7046 Seashore Hwy, Bridgeville Delaware now occupies several acres of the property along its northern border. The deed shows that Daniel and family had removed from Delaware before the October 1795 closing of the property transaction suggesting that they removed from Delaware in the summer of 1795. This closely matches his name appearing on the Greene County, Georgia tax lists beginning in 1797. Traveling with them to Georgia was John Clifton and Curtis Clifton, brothers of Sally, as their names also appear on early Greene County records.
The Georgia Record
The first records of Daniel Kelly in Georgia, is his name on the Greene County, Georgia Tax Defaulter's list for 1797 and 1798 [Augusta Chronicle newspaper issue of 9 February 1799, page 4.] His name then regularly appears as a taxpayer on the 1798 to 1813 Greene County tax records where he listed himself as living on 150 acres of Oak and Hickory along Richland Creek. Richland Creek flows into the Oconee River at the southern tip boundary of Greene County. This property is now underwater and called Lake Oconee formed in 1971 by the Wallace Hydro-Electric Dam on the Oconee River. Beginning about 1808 the tax records show he acquired 236 acres on Little River in newly formed Morgan County and 180 acres in Clarke County.
By 1818 he had removed into Morgan County where he is enumerated as age 45+ as Head of Household with his family in the 1820 Census of Morgan Co. Georgia. Of the three Daniel Kelly families listed in the 1820's this is the only record that fits Daniel Kelly of this genealogy. The 1820 census record also lists a female, age 45+ which is likely Daniel's wife, Sally Clifton, and two males 16-25, which are likely Reuben Brown Kelly and Noah C. Kelly.
In 1821, Daniel Kelly of Morgan Co. Georgia drew two lots of land in Houston Co. Georgia in the 1821 Land lottery. It is not known what became of this land. However, it does not appear that Daniel took to living on this land as his name shows up on the 1824 Tax lists of Morgan Co., Georgia.
On 13 December 1824 Daniel Kelly, Sr. of Morgan Co. Georgia buys 202 1/2 acres of land in Newton Co. Georgia from William Harris for $400. This land is lot #204 in the 9th District of Henry County, now in Newton Co. [Newton Co. Deed Book A, p. 460.] This land is located adjacent and south of land owned by Charles R. Kelly who moved from Walton Co., Georgia to Newton Co. in the early 1820's. Thus, we have Daniel Kelly living next to his son, Charles R. Kelly in Newton Co. in the 1820's and 1830's.
In 1830, Daniel Kelly age 70-80 appears as head of household in Newton Co. Georgia. There are four females, ages 5-30 and one male age 5-10 living in his household. There are no elderly females listed thus suggesting Daniel's wife, Sally Clifton died prior to 1830. The family of Charles Kelly is listed next to that of Daniel Kelly, consistent with their ownership of adjoining land in Newton County, Georgia.
The last record we have been able to find of Daniel is a deed dated 7 January 1838 in Newton Co. Georgia [Newton Co. Deed Book F, p. 154.] wherein Daniel Kelly sold his 202 1/2 acres (Lot 204, 9th District) to John A. Aycock. This is the same land as Daniel Kelly, Sr., purchased in 1824.
Daniel does not appear in the 1840 census, so it is presumed he died between his signing of the deed in 1838 and the 1840 census.
The Family of Daniel Kelly Family
Identifying the children of Daniel Kelly has been problematic as he did not leave a will. The following is the basis for identifying the children of Daniel Kelly.
Daniel Kelly of Greene County. Georgia is listed as being a registrant in the 1805 land lottery drawing 2 blanks. James Kelly of Greene County drew one blank, and John Kelly drew two blanks. (One draw was allowed for single men over the age of 21 with 3 years of residence in Georgia. Two draws for married men over age 21 with 3 years of residence in Georgia.) These lottery records suggest that James and John are the sons of Daniel Kelly, as Daniel is the only Kelly in Greene County.
On 20 January 1808, James Kelly married Polly (Mary) Wyatt in Greene Co. Georgia. This is consistent with James getting one draw in the 1805 Land Lottery. On 16 November 1808, Polly Kelly and John Weathers were married in Greene Co. Georgia. On 17 October 1809, Charles Kelly married Betsey (Elizabeth) Wiley in Greene Co. Both James Kelly, Polly Kelly and Charles Kelly were married by James B. Holt thus showing an association between them. James B. Holt also was a witness to the Will of George Wiley, who was the father of Elizabeth Wiley. As Daniel Kelly was the only Kelly with adult child in Greene County at the time these records suggest that James, Charles, Betsy and Polly were children of Daniel Kelly of Greene Co. Georgia.

In the, "First Families of Henry County, Georgia" by Joseph Moore a section called Kelley of Kelleytown in which it is stated Reuben Brown Kelley (1800-1875) was one of the first settlers of Kelleytown. The Kelley's came from Oglethorpe County. The article went on to say that Reuben B. Kelley was the son of Daniel Kelley and Sally Clifton. They were the parents of five children--- Charles, Jim, John, Daniel and Reuben Brown. We thus have two apparently independent sources of family information handed down via oral family history stating that Daniel Kelly had at least five sons, Charles, James, John, Daniel and Reuben.
Also listed as registrants in the 1805 land lottery “Clifton, orphans of John, c/o Daniel Kelly” who drew one blank. This suggests that by 1804, John Clifton, brother of Sally Clifton, had died, leaving orphan children in the custody of Daniel Kelly. We believe these children were Daniel Clifton born 1795, Rueben Brown Clifton born 1800 and Noah Clifton born 1804. We found no record that Daniel Kelly legally adopted any of these children, but he clearly raised Daniel, Rueben Brown and Noah to adulthood. These children were known as Kelly’s and the children of Daniel and Sally Kelly. Daniel Clifton, who was age 9 at his father’s death, may have been known as Daniel Kelly Jr.in his youth, but by the 1820 census and his 1826 marriage he went by his birth name, Daniel Clifton, which he used for the remainder of his life. Rueben Brown and Noah who were age 4 and 1 respectively at the time of their father’s death, went by the name Reuben Brown Kelly and Noah C. Kelly their entire lives. Only the C. in Noah C. Kelly’s name gives a hint that he was a Clifton at birth.

In 1830, Daniel Kelly age 70-80 appears as head of household in Newton Co. Georgia. There are four females, ages 5-30 and one male age 5-10 living in his household. There are no elderly females listed thus suggesting Daniel's wife, Sally Clifton died prior to 1830. The family of Charles Kelly is listed next to that of Daniel Kelly, consistent with their ownership of adjoining land in Newton County, Georgia.
The last record we have been able to find of Daniel is a deed dated 7 January 1838 in Newton Co. Georgia [Newton Co. Deed Book F, p. 154.] wherein Daniel Kelly sold his 202 1/2 acres (Lot 204, 9th District) to John A. Aycock. This is the same land as Daniel Kelly, Sr., purchased in 1824.
Daniel does not appear in the 1840 census, so it is presumed he died between his signing of the deed in 1838 and the 1840 census.
The Family of Daniel Kelly Family
Identifying the children of Daniel Kelly has been problematic as he did not leave a will. The following is the basis for identifying the children of Daniel Kelly.
Daniel Kelly of Greene County. Georgia is listed as being a registrant in the 1805 land lottery drawing 2 blanks. James Kelly of Greene County drew one blank, and John Kelly drew two blanks. (One draw was allowed for single men over the age of 21 with 3 years of residence in Georgia. Two draws for married men over age 21 with 3 years of residence in Georgia.) These lottery records suggest that James and John are the sons of Daniel Kelly, as Daniel is the only Kelly in Greene County.
On 20 January 1808, James Kelly married Polly (Mary) Wyatt in Greene Co. Georgia. This is consistent with James getting one draw in the 1805 Land Lottery. On 16 November 1808, Polly Kelly and John Weathers were married in Greene Co. Georgia. On 17 October 1809, Charles Kelly married Betsey (Elizabeth) Wiley in Greene Co. Both James Kelly, Polly Kelly and Charles Kelly were married by James B. Holt thus showing an association between them. James B. Holt also was a witness to the Will of George Wiley, who was the father of Elizabeth Wiley. As Daniel Kelly was the only Kelly with adult child in Greene County at the time these records suggest that James, Charles, Betsy and Polly were children of Daniel Kelly of Greene Co. Georgia.

"Great Grandfather Charles Kelly had 3 brothers: Reuben went to Atlanta in early days. John and James - unknown."
In the, "First Families of Henry County, Georgia" by Joseph Moore a section called Kelley of Kelleytown in which it is stated Reuben Brown Kelley (1800-1875) was one of the first settlers of Kelleytown. The Kelley's came from Oglethorpe County. The article went on to say that Reuben B. Kelley was the son of Daniel Kelley and Sally Clifton. They were the parents of five children--- Charles, Jim, John, Daniel and Reuben Brown. We thus have two apparently independent sources of family information handed down via oral family history stating that Daniel Kelly had at least five sons, Charles, James, John, Daniel and Reuben.
Also listed as registrants in the 1805 land lottery “Clifton, orphans of John, c/o Daniel Kelly” who drew one blank. This suggests that by 1804, John Clifton, brother of Sally Clifton, had died, leaving orphan children in the custody of Daniel Kelly. We believe these children were Daniel Clifton born 1795, Rueben Brown Clifton born 1800 and Noah Clifton born 1804. We found no record that Daniel Kelly legally adopted any of these children, but he clearly raised Daniel, Rueben Brown and Noah to adulthood. These children were known as Kelly’s and the children of Daniel and Sally Kelly. Daniel Clifton, who was age 9 at his father’s death, may have been known as Daniel Kelly Jr.in his youth, but by the 1820 census and his 1826 marriage he went by his birth name, Daniel Clifton, which he used for the remainder of his life. Rueben Brown and Noah who were age 4 and 1 respectively at the time of their father’s death, went by the name Reuben Brown Kelly and Noah C. Kelly their entire lives. Only the C. in Noah C. Kelly’s name gives a hint that he was a Clifton at birth.
